Create Allied Health provides specialist social work support for NSW Civil and Administrative Tribunal (NCAT) guardianship matters. Our experienced team navigates the complexities of guardianship law, ensuring clients' rights are protected while facilitating the least restrictive outcomes. We work alongside legal professionals, families, and care teams to deliver comprehensive support from initial application through to post-decision implementation.

NCAT Applications

We provide end-to-end support for NCAT guardianship applications, ensuring thorough preparation and strong advocacy throughout the process.

  • Application preparation — Comprehensive assessment and documentation to support the application
  • Evidence gathering — Collating clinical reports, functional assessments, and supporting documentation from treating teams
  • Documentation — Preparing detailed social work reports and submissions for the tribunal
  • Tribunal liaison — Coordinating with NCAT registry and ensuring all procedural requirements are met

Tribunal Support

Our clinical social workers provide expert support throughout the tribunal hearing process, ensuring all parties are well-prepared and informed.

  • Written submissions — Professional social work reports and position statements for the tribunal
  • Hearing attendance — In-person or virtual attendance at tribunal hearings to provide clinical evidence and advocacy
  • Legal coordination — Working alongside solicitors, barristers, and legal aid services to ensure cohesive representation
  • Post-hearing implementation — Translating tribunal orders into actionable care and support plans

Supported Decision-Making

We champion supported decision-making as an alternative to substitute decision-making wherever possible, in line with best practice and human rights frameworks.

  • Facilitation — Supporting individuals to make their own decisions with appropriate assistance and accommodations
  • Family coordination — Bringing family members together to collaborate on decision-making that respects the person's will and preferences
  • Least restrictive alternatives advocacy — Advocating for the least restrictive option in all guardianship matters, ensuring any order is proportionate and necessary

Guardian Coordination

When guardians are appointed, we provide ongoing support to ensure effective implementation and coordination of care.

  • Liaison with appointed guardians — Working with public, private, and family guardians to ensure consistent, person-centred care
  • Accommodation advice — Providing expert guidance on housing and accommodation decisions within the scope of guardianship orders
  • Implementation support — Ensuring guardian decisions are implemented effectively across all service providers and care teams

Post-Decision Planning

Following a tribunal decision, we support clients and their families through the transition and ongoing implementation process.

  • Tribunal orders implementation — Ensuring all aspects of NCAT orders are actioned appropriately and in a timely manner
  • Transition planning — Developing comprehensive plans for changes in living arrangements, care, and support
  • Service coordination — Coordinating between multiple providers, government agencies, and family members to deliver seamless care
